It would be great if American Justice would do research as well! When people know their own status through proper treatment and testing, coupled with proper and vigilant use of condoms and common sense, the risk of transmittal is nil. No one should be punished if no actual harm has been done. There are still people in the US who will not RIDE IN THE SAME CAR with someone who is HIV+! (Afraid of being in an accident and mingling blood!) Ignorance reigns supreme!

I feel that if you are going around having unprotected sex with random people then you are just as guilty as someone who is pos. If you are protected then its your choice to inform the other party. If you are not protected no matter how low your chances of passing are, you should disclose. At least give a chance. Again, you are foolish to think that everyone will so why put yourself at risk and then point the finger. You play with fire, you will be burned!

Anyone running around having unsafe sex these days is just a stone fool! I contracted HIV in 2004 because I gave up on life and didn't care. If you're concerned about contracting HIV you should ALWAYS use a condom and POZ people should always disclose, albeit many didn't with me...some even afterwards, but I didn't go running to the cops, as I knew the risks beforehand.

What if you had sex and did not disclose and then you ended up having a relationship with one of your partners? What then? I agree with the judge but I always disclose. I guess thats why I haven't had sex in a LONG time.

I cannot believe this judge, if your positive no matter if your viral load is ok you are still infectious the fact the mna didnt tell the people is a criminal offence by gaol, here in the uk, and so it should be our latest positive criminal was given 10 yrs gaol

It has been a long time since I've had to disclose. I've been poz for 23 years and I'm 67 y.o., so I don't get many opportunities to have sexual relations. In the past, I always disclosed, however, I agree with the judge that this man was of no "significant risk" because he wore a condom and his HAART regimen made it unlikely that he was infectious. If I get the opportunity to once again have sexual relations, I will still disclose before hand, but agree with the judge in this case.

I feel even someone were condoms, they are not always safe, they break all the time and even take meds. You should let your sex partner know all times that you are poz.
