Medicaid funding has been terminated for a California surgeon who discriminated against a patient with HIV by refusing to perform back surgery, according to a statement by the Department of Health and Human Services (HHS), which issued the order. HHS found that Winston C. San Agustin, MD, violated the Rehabilitation Act of 1973, which prohibits disability discrimination by health care providers who get federal funds. The termination comes after the surgeon declined an HHS request to comply with the act.
