Former Employee Sues Delta Air Lines for HIV Discrimination
A former employee of Delta Air Lines is suing the company for disability discrimination and harassment resulting from his HIV status, according to paperwork filed in Los Angeles Superior Court. Jose Villasenor began working for the company as a baggage handler in 2000. A decade later, he was diagnosed with HIV. The lawsuit alleges that the illness and medication caused him to miss work and led to harassment from coworkers, violations of his privacy, and ultimately the termination of his employment. Villasenor filed a total of 13 claims against Delta, including wrongful termination, labor code violations and intentional infliction of emotional distress. He is represented by Natasha Chesler of the Law Offices of Timothy B. McCaffrey Jr.

I was fired from Delta in April 2012, less than two years after I was diagnosed with AIDS. I can echo many of this mans claims.

I am a Delta Employee (18 years) I have never had an issue at work. Delta is a great company to work for and is very gay friendly and supportive. We even have a gay employee group. As for this fellow missing work because of his illness has to be an excuse. If he is on meds and takes care of himself he won't be missing work. I am sure he was fired for abusing policies. I hope Delta wins this case. I am sure they will settle out of court just to shut him up. Far to many people try to sue.

I am a Delta Employee. I am at constant fear of keeping my employment. Badgered by management about Heatlh information. Blatant ADA violations. I am hearing this from persons within multiple departments. It is exhausting trying to address it.

As a flight attendant for another carrier it has always been common knowledge that Delta had a tougher position against their hiv+ employees than other airlines. I wish this man the best in his pursuit of justice.
