A man from Fort Myers, Florida, was arrested for allegedly giving another person HIV without disclosing his status, WBBH reports. The plaintiff from Lehigh Acres said he had consensual sex with the defendant in May, then tested HIV positive after feeling ill in June. The plaintiff claims that he had sex with no one else since May, that an in-home test before that encounter showed he was HIV negative and that the defendant did not disclose his HIV-positive status prior to sex. An attorney for the defendant provided officials with medical records confirming his client tested HIV positive in 2010. As a result of the arrest, a second man has accused the defendant of nondisclosure before sex on two occasions, but no charges have been filed so far in the second case.
