The Justice Department reached a settlement with Genesis Healthcare System involving claims that it discriminated against an HIV-positive woman, which violates the Americans With Disabilities Act (ADA), according to a Justice Department press release.

The Genesis network includes doctors and health care centers in southeastern Ohio. After investigating the case, the department concluded that Genesis discriminated against the woman when one of its primary care doctors refused to accept her as a patient because of her HIV even though she was seeking general care unrelated to HIV. As a result she had to go to an emergency room for a non-emergency health issue. It turns out that this doctor had done this with other HIV-positive patients who needed general care.

As a result of the settlement, Genesis will pay $25,000 to the woman and $9,000 as a civil penalty. Genesis must also train its staff about the ADA and develop nondiscrimination policies.

This marks the latest in a series of Justice Department settlements about HIV discrimination and resulting from the department’s Barrier-Free Health Care Initiative. Previous cases involved Rite Aid of Michigan, a bariatric clinic, a dentist and others.
