HIV Tests for Delaware’s Accused Sex Offenders
A bill that would mandate HIV testing for accused sex offenders passed the Delaware House Judiciary Committee on Thursday, the Associated Press/Washington Examiner reports (examiner.com, 6/9). The bill is now headed for the state house of representatives, which must approve it before it can become law.
A current Delaware law requires some indication of possible HIV transmission, such as an exchange of body fluid, before a test can be administered to anyone arrested on sex-crime charges. This amendment to that law would allow HIV testing within 48 hours of a sex-crime arrest if ordered by a court or requested by a victimized party.

I am the victim of an HIV+ sex offender lying about his status & his background. He has infected countless women & girls here in Philadelphia. What advise would you give to help direct me in fighting to have this law implemated here in Phila.PA

An allegation means nothing unless proven. HIV testing should be limited to the presents suspect’s DNA in the victim. Any positive result will create undue bias among both investigators and a jury. If there is a concern with infection appropriate medical care should given to the victim first. However I do believe that convicted sex offenders should be tested. Their guilt has been established beyond a reasonable doubt. Due process is what makes America the land of the free. Remember that.

I believe that this is a good idea. This way the victim can be notified if they test positive. I might even go as far as having anyone who gets arrested for any crime having to be tested at that time. Especailly for all those who are about to enter a prison and then those who are about to be released from prison should be tested.
