Court Commits Mentally Ill, Positive Man for Unsafe Sex

Minnesota’s Court of Appeals upheld a decision to have David Kendall Renz civilly committed to a secure facility for admittedly engaging in unprotected intercourse without informing his partners that he is HIV positive, Gay City News reports.

Though none of Renz’ victims has been identified, the Court of Appeals concluded that the trial court made no mistake in deeming Renz “mentally ill and dangerous” because he confessed to having unprotected sex with five or six sexual partners during the past year.

A court-appointed doctor testified that if released, Renz would likely be “sexually active in a way that puts him at higher exposure for engaging in reckless sexual behavior, in part due to his psychiatric state.”

Renz’ commitment is indefinite, meaning it will only end once it’s determined that he is lo longer a danger to others.
