NYC Judge Upholds Condoms With Political Messages
A New York City judge has dismissed illegal
vending charges against a man selling condoms labeled with political messages, the
First Amendment Center reports. The seller, Jose
Andujar, lacked a vendor’s license, but city law provides an exemption
for “newspapers, periodicals, books, pamphlets and
other similar written matter.” Judge Lynn R. Kottler ruled that this was
covered by the legislation because purchasers would buy the condoms for the
messages on their wrappers rather than for prophylactic use. The messages on
his condoms included “Hope Is Not a Form of Protection” in reference to
President Obama and “When Abortion Is Not an Option” in reference to Sarah
Palin.
