The 11th Circuit Court of Appeals has heard a brief on behalf of a Georgia man who was allegedly denied employment as an Atlanta police officer because he is HIV positive, according to a statement from Lambda Legal, which is representing the man. The 39-year-old plaintiff, whose identity remained anonymous during proceedings, was allegedly told that his HIV-positive status disqualified him from becoming an officer with the Atlanta Police Department. His status became known during a pre-employment medical examination. Both the man's initial suit and his appeal charged the City of Atlanta with discrimination and violations of the Americans with Disabilities Act and the federal Rehabilitation Act.
