Remember this headline from last month: “Aetna to Pay $17M Because It Mailed Envelopes Revealing HIV Info”? Well, that may not be the last word on the matter. As Reuters reports, the health insurer is now suing its claims administrator Kurtzman Carson Consultants, alleging that KCC is at fault for the privacy breach.

Aetna claims that KCC never alerted Aetna that it was mailing the letters in envelopes that had windows and failed to test the windows to ensure that they didn’t reveal personal medical information.

Aetna claims that KCC has not only refused to compensate the insurer for its gross negligence but also has failed to return confidential health records.

Reuters posted a PDF of Aetna’s complaint; you can read it here.

In the class action lawsuit filed against Aetna last summer, some of the insurer’s clients said they suffered serious consequences when their HIV information became public. One woman said she had to leave her home and another alleges he was the target of vandalism. For more, click here.
