The prosecution is a knee-jerk reaction, to a disease that is no longer a killer.

In response to Richard,I am not advocating anybody spreading H.I.V,when I testested poz,i didn't blame anybody,but from 1979-2009 I escaped H.I.V,my point is young gay men need to view all internet trade as h.i.v,your gonna take the word of a total stranger with your health,he may have tested neg last month,who was he with last week,some people will lie or don't care,I'm retired from sex life now,not judging ,but putting people in jail,I remember the 80's no hope,is this what we fought for.

Tracy, this article does not mention Mr Johnson having a fully suppressed HIV viral load. Hence, he had a viral load. And the recordings show that he knew he was a risk to others. He just ignored his risk to others and went ahead and had risky sex with others anyway. Tracy and Jason, yes it's our responsibility to watch out for ourselves. But it's also our and others' responsibility not to put another person knowingly at risk of an any STD.

We hear stories about appeals being reverse because of prosecution not doing the right things or withholding information from the defense so they can't prepare for their case. What about military Soldiers that has being falsely accused no one seems to care about their lives I put in 17 years of my life willing to die for my country and I was falsely accused of touching a Caucasian female Soldier buttocks who had no witnesses, inconsistent statements, hidden evidence, no police report.I need help

Your own health is your responsibility. I feel you must treat everyone as HIV+. HIV criminalization perpetuates the reason why HIV is more prevalent in the gay community. Most people won't get tested in fear of being diagnosed and criminalized.

HIV/AIDS has been known since 1981, and we are trying people for having unprotected sex? Where is the responsibility of the partner? They know about how to protect themselves. Why is it always the fault of the accused? If your viral load is 0, you can't transmit the virus. So what about people with Herpes and other STD's. Why is that not criminal? I got that from someone. I got HIV from a guy who didn't disclose. I didn't sue him. Should I have. No, I knew about how to protect myself. I didn't.

In reply to Gmbhivsenior: The only way a "good" lawyer would get this guy off this conviction, if it hadn't been overturned already on a technicality, would be to dispute HIV antibody tests, dispute HIV existing, dispute HIV as being a cause of AIDS. Is this what you are advocating? Are you advocating that the "good" lawyer stops the jury and judge seeing HIV as an STD? Because this guy did knowingly put the people he had sex with at risk of contracting HIV from him didn't he?

People are not dying from hiv like they use to thanks to the meds Of today. Disclosing of personal health information is such an invasion of privacy and another form of segregation. If you are going to have unprotected sex with ANYONE take into consideration, You agreed to play pass the ball, so u r responsible. Noone should have to disclose their info, if you treat everyone you lay with as if they were poz. Save yourself!! its not the infection -it's the reinfection.
