I think the federal system in USA is the main reason of these case. In Brazil the criminal law is federal (just one applied for all country). So this fact easyly would be considered unconstitutional. HIV Criminalization is also considered unconstitucional according to Federal Brazilian Supreme Court. In USA, the laws depending on each State which can have more or less conservative tradition.
Any excuse for the morality police to punish anyone who doesn't adhere to their moral code. I suppose that morality is more of an art and who cares about consistency or reality when you can score political points and punish people for having sex?
Utterly ridiculous!!! New York, Los Angeles, Washington, DC and San Francisco have high rates of HIV - are they trying to make it worse???
We are supposed to be one of the most educated countyries out there but it seems time and time again that we are so ass back wards. Lets step it up into the 2000's and not the 1800's.
This doesn't surprise me, nobody said you have to be educated to be a cop. Condoms should be the last thing they are looking for, everyone should carry one to prove a point. They may be guilty as well.
I can't believe this article. Possession of a condom is being criminalized?! This can't be true. All the outreach, donating condoms to sex workers and teens goes down the drain -- and the HIV infection rate may rise as a result. How about vice police doing real policing, not relying on possession of a condom?
This is utterly absurd and will increase the cost of health care for decades to come. Are we going Backwards, 30 years, to the days of President Reagan when the bureaucracy wouldn't mention HIV/AIDS?

I think Patrick has it right. If the local AIDS service org in those cities would encourage everyone to carry condoms, then the defense attorneys can argue that possession of condoms proves nothing.
