Yes' "Safe Harbor" is reasonable and a good idea. If you have HIV and have an undetectable VL then clearly your having sex with someone else is being safe vis a vis HIV - condom or no condom. But your VL can change AND you would also be putting your self at risk of getting other STDs. So condom use would be best anyway in such an instance. It would though be criminal to have sex with someone if you do have an HIV VL and do not tell the person, or if you have any STD and do not tell the other.
