A New York City judge has dismissed illegalvending charges against a man selling condoms labeled with political messages, theFirst Amendment Center reports. The seller, JoseAndujar, lacked a vendor’s license, but city law provides an exemptionfor “newspapers, periodicals, books, pamphlets andother similar written matter.” Judge Lynn R. Kottler ruled that this wascovered by the legislation because purchasers would buy the condoms for themessages on their wrappers rather than for prophylactic use. The messages onhis condoms included “Hope Is Not a Form of Protection” in reference toPresident Obama and “When Abortion Is Not an Option” in reference to SarahPalin.
