I need to do homework on the details of the case, but I see these situations being painted with the broad brush of "HIV criminalization", which isn't responsible. Having HIV isn't a crime, nor it should be. Exposing people to HIV, knowingly, without their choice should be. I don't understand the disagreement with this. If someone exposed me to any other potentially lethal toxin, generally we'd agree with that being a crime as well. No?
Mike, as new generation I say if we increase the testing rate and we don't change the laws then we will fulfill conservative answer for aids in the 80's .. Let's put all aids people in concentration camps (being the concentration camps our prisons). There are many reasons why people may not disclose.. Domestic violence, no protections if word gets out, threats, shame, vilified stigma. No everyone who test hiv pos is gay and may find the answer in hooking up in a poz dating site.
As a 60yr H.I.V. gbm,if we quit getting tested we will go back to the 80's & 90's,i say get informed ,get involved and by all means vote,we minorities didn't vote in November,here in the bible belt,the anti gay rhetoric never stops,there are H.I.V. pos dating sites,its hard to except I know,why would you try to date negative people in this conservative region,to change laws we must change our politicians,some of you are too young to remember the unity of the 80's,please vote Nov 2016.
I support the idea iamstilljosh in twitter. Until these laws aren't repeal people should decline testing or test anonymous or with an organization willing to not disclose. People still testing just because many are not aware of this criminal cases. I volunteer in a clinic and I am not planning to do more of this work unless I am allowed to inform the patient what legally waits after a positive test. Will that deter testing.. Most likely yes. But it won't then that courts will change the law.

Mvapex, I am sorry for engaging. I am still at shock by this outcome. Reality is than with condoms, prep, etc being widely known and available the idea of someone "exposing" you to hiv is not sustainable as a concept. You "expose" yourself to hiv when having unprotected sex with people that might know and many who still don't know are carriers of the virus. It is a simple as that. So unless someone is not putting a needle full of hiv poz detectable blood down your vein, nobody can't expose you.
