Windy Heath was a student in the cosmetology program at Virginia College in Knoxville, Tennessee, when she was called into the dean’s office and told that because she has HIV she could no longer attend the school, reports WVLT, Local 8 News.

Heath says that she is undetectable and is aware of precautions but that she told the dean about her status because she wanted to be transparent.

The Americans with Disabilities Act prohibits public accommodations such as schools and colleges from discriminating against people with disabilities, including HIV.

Heath later met with the president of the college, Sergio Takahashi, and recorded the exchange. Takahashi acknowledged the school’s error. “There was a misunderstanding and misconception of what that description of policies was and the rules and everything else,” he can be heard saying.

Takahashi offered Heath a chance to reenroll, but Local 8 News reports that she hasn’t made a decision yet.

Following up on the story, activist Josh Robbins of ImStillJosh.com spoke with Heath, who says she has been in contact with a lawyer and plans to file a suit against the college.
